Farm Accommodation and Transport: Check the Deduction Before Payroll

A rent or transport charge on a roster spreadsheet is not enough to establish that it can be taken from wages. Before payroll applies a deduction, the employer needs to identify the lawful basis and check the arrangement against what was actually supplied.

Do not treat a signature as the whole test

Fair Work’s horticulture guidance describes limited circumstances for deductions. One basis is written employee agreement where the deduction is principally for the employee’s benefit; other bases may come from law, an award or a registered agreement. Employers cannot pressure employees to agree. The guidance’s accommodation example shows why written consent alone should not be assumed to resolve every requirement.

Separate the service record from permission to deduct

A useful payroll review identifies the service period, the charge, its basis and the relevant authority. Check changes in occupancy, transport use and the agreed arrangement before copying last week’s amount. Keep the supporting explanation accessible to the employee. PALM arrangements also require checking the scheme’s current rules and the approved circumstances; a general Fair Work check does not establish PALM compliance.

A hypothetical move between houses

A worker moves accommodation midweek, but the payroll file retains a full week at the previous charge. The correction needs both an accurate service record and a check of the applicable deduction arrangement. Simply obtaining another signature after the event is not a substitute for establishing the right amount and lawful basis.

Resolve disputed amounts deliberately

Identify a contact who can explain the charge and investigate an error. Do not assume an alleged overpayment can automatically be recovered from the next wage: Fair Work says recovery deductions are limited. Where the legal basis remains unclear, obtain specific guidance before applying it. Keep wages, service charges and any repayment discussion clear enough for the worker to understand.
