After a Workplace Death: Victorian WorkCover Family Support Changes That Already Apply

Featured image: an illustrative rural road at dusk, with a person making a call beside a farm vehicle. Not a specific Orchard Tech workplace or incident.

Legal position checked: 10 September 2026. Victoria. Changes to family support under the Workplace Injury Rehabilitation and Compensation Amendment Act 2025 already apply. WorkSafe records commencement on 6 August 2025 and further pension changes on 1 November 2025. Do not describe this package as a 2026 reform that has not started.

A harvest supervisor calls the labour hire coordinator after a fatal incident on a host property. The crew is still in the car park. Family members are arriving. Three businesses are on the phone: the host, the provider, and an insurer.

That is a hypothetical. The question this article answers is not how to investigate the incident. It is: who makes sure the family is not left waiting while the companies argue about whose claim it is?

WorkSafe’s current page on changes to the WIRC Act is the primary status source.

What already commenced

On 6 August 2025, among other things, WorkSafe records:

  • Longer provisional pension payments after a work-related death.
  • Provisional payments for a person who may be entitled to compensation following a death caused by suicide.
  • New lump sum payments for economic loss suffered by dependants who are not parents or children.
  • A new lump sum payment for grief and loss suffered by close family members.
  • A higher cap for family counselling, including therapy and support services after a work-related death or where a worker has a severe injury or eligible progressive disease, with therapy and support of up to $10,000 for future claimants as described by WorkSafe.
  • Power for the Minister to direct a broader range of therapy and support services after a work-related death.
  • Access to compensation for the reasonable costs of forensic cleaning.

On 1 November 2025, WorkSafe records an increase to the weekly pension for dependent children.

Those dates are in the past. A 2026 article that talks about “upcoming family support changes” would mislead a host.

What this is not

These compensation changes do not replace:

  • Immediate incident notification to WorkSafe under the OHS Act.
  • Site preservation duties.
  • The separate psychosocial hazard duties that already apply to the living crew.
  • The Code of Claimants’ Rights, which is not yet operating and is covered in a companion draft.

Eligibility for a particular payment still depends on the facts of the claim. This article cannot tell you whether a named person will be accepted as a dependant.

Labour hire placements: two employers, one family

Where the deceased person was a labour hire worker, the provider is usually the employer for workers compensation. The host still has OHS duties for a workplace under its management and control, and may have its own notification duty if the incident occurred there.

WorkSafe’s incident guidance is explicit that more than one employer can have a duty to notify. A principal and a labour hire provider can both be employers. “We thought the other company would call” is not a notification system.

For the hypothetical harvest fatality, agree in writing, before the season, who will:

  1. Call emergency services and 13 23 60.
  2. Preserve the site except to protect life, aid the injured or make the area safe.
  3. Name a single family contact so relatives are not given three conflicting stories.
  4. Start the workers compensation and provisional payment pathway through the correct employer’s agent.
  5. Support other workers on the crew, including how they leave the property and who they can call.

Keep medical and family details off group chats. Limit disclosure to people who need it for the response.

Provisional payments are not a courtesy

WorkSafe describes an extension of provisional pension payments and, in specified suicide-related death claims, provisional payments for a person who may be entitled to compensation. The point of provisional support is that families should not wait for every dispute to finish before any money or services begin, where the Act provides for that pathway.

A host who tells a family “wait until the investigation is over” may be describing their own legal advice. It is not a description of the scheme. Direct the family to WorkSafe and the employer’s agent, and do not bargain about entitlements in the paddock.

The rest of the crew

After a death, the remaining workers face workload shock, conflicting instructions and isolation — the same psychosocial hazards the Psychological Health Regulations already require employers to control. Sending people back to the same block “to keep the harvest moving” without a pause to reset supervision is a decision that can create further risk.

Ask, privately, whether anyone needs to stop work, how they will get home, and whether they have a contact other than the supervisor who was on the block. Then follow through.

A host and provider checklist

Suggested preparation, not a prescribed form:

  • Is the workers compensation policy current for the actual employing entity, not only the trading name on the ute?
  • Is there a named after-hours contact at both businesses who can reach the other within minutes?
  • Does the induction tell workers who to call for a serious incident, in a language they can use?
  • Does anyone other than the site supervisor know how to notify WorkSafe?
  • Have you written down how family contact will be handled so it is not improvised at the gate?

For licensing and supplier identity, which is a different legal track, see Victoria’s October labour hire changes. To discuss a Victorian placement, use the employer enquiry page.
