A $158,400 Visa Compliance Penalty: What Farm Employers Should Check Before the First Shift

A worker can be lawfully in Australia and still lack permission to do the job you are offering. That distinction belongs in a farm’s recruitment process before a person is allocated their first shift.
On 14 September 2026, Australian Border Force reported that a Queensland freight company had paid a $158,400 infringement notice for alleged Migration Act breaches. Its investigation identified one person without lawful immigration status and another who was lawfully in Australia but working contrary to visa conditions. This was a freight-sector enforcement case, not a farm prosecution or a reported court conviction. The amount is not a standard penalty for every employer mistake.
Check permission for the actual work
Home Affairs’ Visa Entitlement Verification Online service (VEVO) lets visa holders and eligible organisations check current visa details and conditions. A passport establishes identity; it does not, by itself, establish permission to work. An old grant letter can also miss a later change in a person’s visa status.
Build the check around the proposed job, employer, location and hours. Where the result includes a restriction, identify what it means for this engagement before adding the person to a roster. Do not infer that every worker holding the same visa subclass has identical conditions.
A proposed first-shift work-rights register
This is a suggested internal register, not a prescribed government form. Use one record per worker and restrict access to staff who need it.

Keep the supplier and host’s records connected
For labour hire, agree who checks the worker’s current permission, who checks that the proposed assignment fits it, and how a change reaches the host’s roster manager. A generic assurance that “all workers have visas” does not answer the question about a particular person doing particular work.
A useful supplier confirmation identifies the worker by the agreed internal reference, the date checked, whether the proposed assignment is consistent with the result, any operational restriction and the next review trigger. It need not circulate a passport image to every supervisor. Share personal information only where it is needed and through the agreed secure channel.
Hypothetical example: a supplier replaces a crew member the evening before a harvest shift. The host should not copy the previous worker’s cleared status to the replacement. The replacement needs their own identity and work-rights confirmation, followed by the normal site induction.
If the result is unclear
Ask the worker and responsible employer to resolve the specific discrepancy using Home Affairs information or appropriately qualified advice. Do not guess a condition’s meaning or pressure someone to breach it. A work-rights concern also does not settle separate questions about pay already earned or employment entitlements.
